Probate is the legal proving that the Will is valid. When a person dies with a Will the Will must be filed with the Surrogates Court of the County where the Decedent resided. The Will must be admitted to probate by the court. The Surrogate's Court judge must be convinced that the Will is authentic and valid to be admitted to probate under Surrogate's Court Procedures Act (“SCPA”) §1408 and EPTL § 3-2.1. Upon admitting the Will to probate, the Executor named in the Will, if he or she qualifies, is appointed to distribute the assets of the estate and fulfill the wishes of the deceased and pay the taxes, bills, and expenses of the estate.
